Consultation on abusive discrimination
OrderWe help you as an employer to investigate suspected discrimination, bullying, harassment and other types of mistreatment in the workplace. The service is based on legal requirements according to AFS 2015:04.
What it is
Investigation of Abusive Discrimination provides support in situations concerning discrimination, bullying, harassment and other types of mistreatment in the workplace. The employer always has a responsibility to investigate if suspicion exists.
The service is an initial consultation where we conduct a thorough assignment dialogue and consultation with the aim of clarifying the complexity and ensuring which measures need to be taken. The consultation is done in two stages.
- Stage one: Current situation analysis, history and timeline, previous efforts and effects, the behavior of those affected and additional relevant circumstances.
- Stage two: Preliminary assessment of whether it is a case of violation/bullying, discrimination, harassment, conflict, misconduct, infected managerial/personnel matter, and so on.
After the consultation, you decide for yourself whether you want to proceed with Pre-assessment, advice and support.
Pre-assessment, advice and support
Pre-assessment, advice and support are suitable in case of suspicion, of an unclear report or if there is a need for clarification about scope, seriousness and problems. The work is led by one of our experts and includes:
- An in-depth dialogue with clients / HR managers and planning
- Analysis of available/ known and concrete information
- Interview and dialogue/ feedback with the person or persons who reported
- The person(s) may read the interview
- Compilation, analysis, assessment of whether fact-finding may be appropriate
- Second opinion of senior Falck consultant
- Oral report, recommendations and advice
Again, you can choose to end the work here or continue with Fact Finding to support good case management.
Fact-finding
Fact-finding is appropriate when there is a completed report or in case of strong suspicion of victimization, bullying or harassment. You are aware of the complexity and is informed about the investigation method. The work is led by one of our experts and includes:
- Investigation and clarification of facts related to reported or suspected occurrence of victimization / bullying / harassment. This is done in accordance with AFS 2015:4, Organizational and social work environment.
- To review and clarify whether the employer has the necessary policies and procedures and whether they have been applied.
- Based on the results of the investigation, it is assessed whether violation/ bullying / harassment has probably occurred or not, as well as underlying circumstances.
- Based on AFS 2015:4 and the results of the investigation, recommendations are made for appropriate preventive and remedial measures.
